FormLLC.ca ("we", "us", "our"), a service operated by Middleman Marketing Ltd. in Canada, is committed to protecting your personal information. This Privacy Policy explains what we collect, why, how we protect it, and your rights. We handle personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).

1. Information We Collect

To form your LLC, prepare your EIN application, and deliver your documents, we collect:

  • Identity information: your full legal name as it appears on government-issued identification.
  • Contact information: Canadian mailing address, email address, and, if you choose to provide it, phone number.
  • Business information: proposed LLC name, backup names, business purpose, and membership structure.
  • Social Insurance Number (SIN): required by the IRS on Form SS-4 for non-resident applicants. Collected separately, via an encrypted submission link, after your initial intake.
  • Payment information: processed by Stripe. We receive a confirmation of payment but never see or store full card details.
  • Technical information: standard server logs (IP address, browser, pages visited) for security and analytics.

2. How We Handle Your SIN

Your SIN is sensitive personal information. We treat it accordingly:

  • It is collected only via a separate, encrypted submission link sent to your verified email after your intake form is received. It is never collected on a public form.
  • It is used solely to populate IRS Form SS-4 in order to obtain your EIN.
  • It is stored encrypted at rest and accessible only to the staff member preparing your filing.
  • It is deleted from our active systems within seven (7) days after the IRS issues your EIN.

3. Why We Collect This Information

We collect personal information only for the following purposes:

  • To form your LLC with the Wyoming Secretary of State
  • To prepare and submit IRS Form SS-4 on your behalf
  • To deliver your completed documents
  • To communicate with you about your order and provide customer support
  • To comply with our legal and regulatory obligations

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

4. How We Store and Protect Your Information

Your information is stored on encrypted servers with access controls. Access is restricted to staff members who require it to perform the Service. We use industry-standard safeguards including TLS encryption in transit, encryption at rest for sensitive fields, and regular access audits.

5. Third Parties We Share Information With

We share only the information necessary for each provider to perform its function:

  • Stripe — payment processing. Stripe receives payment information directly from you.
  • Formspree — secure form submission delivery for your intake form.
  • Wyoming Secretary of State — the information required by Wyoming to file your Articles of Organization.
  • Internal Revenue Service (IRS) — the information required on Form SS-4, including your SIN, to issue an EIN.
  • Email service provider — your email address and order details, used solely to send transactional emails.
  • Registered agent service provider — your business and contact information so the registered agent can accept service of process.

We do not authorize any of these providers to use your information for any purpose other than performing services for us.

6. Retention

We retain your information only as long as necessary:

  • SIN: deleted within seven (7) days after EIN issuance.
  • Identity and contact information: retained for seven (7) years to comply with Canadian record-keeping requirements.
  • Filing records: retained for seven (7) years.
  • Marketing email lists: retained until you unsubscribe.

7. Your Rights

Under PIPEDA, you have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your information, subject to legal retention requirements
  • Withdraw consent for future processing (this may prevent us from completing the Service)
  • File a complaint with the Office of the Privacy Commissioner of Canada

8. Cookies

Our site uses essential cookies for security and basic functionality, and may use analytics cookies to understand how visitors use the site. You can disable non-essential cookies in your browser settings without affecting your ability to complete an order.

9. Children

The Service is intended for adults aged 18 and over. We do not knowingly collect information from minors.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with a revised effective date.
